This Privacy Policy constitutes a legal agreement between Dr. BreathE ("we", "us", "the service") and you ("you", "your") as the user of Dr. BreathE. If you do not agree with the terms of this Privacy Policy, we request that you refrain from using the service.

Respire AI exclusively collects data that is relevant to the functionality of the service we offer.
Respire AI will collect all data you input into the app, including age, weight, sex, and additional information such as ethnicity, your snoring condition, and self-taken photographs. This comprehensive collection ensures you can fully restore your Respire AI data on various devices, maintaining continuity and personalized service.
We do not collect self-taken photographs and audio recordings unless they are explicitly provided to us by you.
When you use Respire AI, the application assigns you a unique anonymous identifier (UUID). This UUID helps monitor your app usage, interactions with different features, and gathers statistics on your breathing disturbances and snoring. Although it collects data, it's designed to ensure your personal identity remains undisclosed. A summary of these results is sent to our secure servers.

We leverage this data to drive research, innovate app features, and solve problems by conducting data analysis and experiments. This is to improve our products and services and to research how users’ results vary based on different criteria on an aggregate basis.

For example, we may study the relationship between users' selfies and their snoring, and understand the condition of snoring based on other data, including questionnaire data. The results of this research may be published within the app or elsewhere, but will not include any data that could personally identify you.

Respire AI does not automatically collect or store audio recordings when using the app. When you allow the use of audio recording for the snoring recognition function, we do not store your original audio data, only the calculated snoring-related statistical values and results.

Please be aware that if you opt to disseminate your selfie and audio recordings via public channels, such as social media or email, or share them with healthcare professionals, they should not be deemed confidential. In such cases, Rspire AI disclaims any responsibility for any unauthorized manipulation or utilization of this information.

Whenever you utilize the app or reach out to our support through email, we automatically gather the following details:
Device Data — details regarding the mobile device you employ to use Aspire AI, which encompasses the hardware model, operating system along with its version, log files, timestamps, and distinct device identifiers.
Information gathered through cookies and other tracking technologies — we employ diverse technologies to gather data regarding your engagement with Aspire AI, including how often you use it and your interactions with its features.

Respire AI is designed to enhance your experience by providing various services. This includes:

• Analyzing, operating, maintaining, and improving the app.
• Introducing new features and services.
• Enabling the transfer of data across your devices.
• Customizing the content displayed within the app.
• Verifying user identity.
• Offering customer support and addressing inquiries and requests.

• Account Deletion: When you delete your account in Respire AI, all data associated with your account will be permanently removed from our systems. This includes your personal information, preferences, and any data you have entered or generated within the app.
• Immediate Data Removal: Unlike apps with online backup features, Respire AI does not store your personal data on remote servers for backup purposes. Therefore, once you delete your account, your data is irretrievably erased from our systems without any delay.
• Irreversible Process: Please be aware that this action is irreversible. Once your account and its associated data are deleted, they cannot be recovered. We recommend ensuring you have saved any necessary information elsewhere before proceeding with account deletion.
• Residual Information: While your account data will be deleted, some anonymized or aggregated data may remain within our systems for analytical purposes. However, this data will not be linked to your identity or be personally identifiable. 

Please note that shared content may remain visible to others even after your account deletion.

EU residents have specific statutory rights regarding their personal data as outlined by the General Data Protection Regulation (GDPR). Subject to any applicable legal exemptions, you may have the right to request access to your personal information and to ask for it to be updated, deleted, or corrected:

Correction of Personal Data and Restricting Its Processing: It is your responsibility to ensure that the personal information you provide to Respire AI is accurate. Inaccurate information can impact your experience using the Respire AI app. If you believe your personal data is inaccurate, you can reach out to us and request a correction of such personal data via support@drbreathe.ai. You also have the right to request a restriction on the processing of your personal data, especially if you dispute the accuracy of the data and we require time to verify its correctness.

Access to Your Personal Data: The app provides a mechanism to access and update your personal data through your account settings. You have the right to inquire if we hold any personal data about you by contacting us at support@drbreathe.ai.

Erasing Your Personal Data: If you feel that your personal data is no longer needed for the purposes for which it was initially collected, or if you have withdrawn your consent, object to the processing, or believe the processing does not comply with the GDPR, you have the right to ask us to delete such personal data. Technical reasons may also cause delays in the deletion of certain data.

Right to Object to the Processing of Your Personal Data: You have the right to object to the processing of your personal data and to halt further processing by contacting us at support@drbreathe.ai. Note that deleting certain data may impact your ability to utilize the app fully.

Notification Requirements: We are committed to informing you and your data protection authority within 72 hours about any breaches of your personal data within the app, providing notifications within a reasonable timeframe.

Data Protection Authorities: Under GDPR, you also have the right to (i) limit our use of your personal data and (ii) file a complaint with your local data protection authority if you believe our activities are non-compliant with GDPR.

For ambiguous requests regarding these rights, we may engage with you to clarify your motivations and locate the relevant information. If clarification is not possible, we reserve the right to deny your request.

In line with GDPR provisions, we may require you to verify your identity to ensure that requests do not infringe on others' rights and are made by an authorized individual.

Please be advised that we will address your request within 30 days of receipt, but some actions, like complete data erasure from backup systems, may take up to 90 days due to the size and complexity of our data storage systems.

Respire AI provides a service that analyzes your selfie photo and recognizes snoring sounds to help you gain insight into them, aiming to provide you with tools to understand breathing disorders, reduce snoring, improve sleep quality, and promote better health.

These Terms of Service constitute a legal agreement between you and Respire AI (provided by Dr.BreathE) regarding your use of the Respire AI mobile application (the "Application"), the computer systems and files used by the Application, and all related services, features and content provided by Respire AI through the Application, website or social media channels.

Please read this Agreement carefully. By using Respire AI's services or registering an account on our services, you accept and agree to be bound by the terms of this Agreement. If you do not agree to any term of this Agreement, do not use the Application. We may modify this Agreement from time to time. Continued use of the Application will be deemed acceptance of the updated version.

The Respire AI application and all related materials are protected by copyright and other intellectual property laws. Reproduction, distribution or any use of the application or any portion of it for commercial purposes without the express written permission of Dr. BreathE is prohibited.

To access specific features within the Respire AI app, such as cloud backup, you are required to create an account. During this process, you will be asked to provide information including but not limited to your full name, email address, age, sex, race, neck circumference, and responses to a lifestyle habits questionnaire. This information will be utilized in accordance with our Privacy Policy. You agree to provide accurate and current information and commit to updating your details should they change.

If you are under the age of 18, your parent or guardian must read and agree to the terms of this agreement. By using the app, you affirm that your parent or guardian has been informed about and accepted these terms.

Please be aware that the additional information we collect, such as race, neck circumference, and lifestyle habits, is aimed at enhancing the personalization and accuracy of the services provided by the app. This data may be used to improve app functionality and user experience and could be utilized in health-related research and analytics to offer more tailored advice and services to our users. All personal information will be processed in strict compliance with relevant laws and our Privacy Policy.

Any information you submit through the app or data recorded while using the app, such as snoring patterns, is governed by Respire AI's Privacy Policy. You are responsible for all your activities within the app. This responsibility extends to any feedback you provide via the app or directly through our support email channels.

When you utilize our website, respond to questionnaires, or interact with us via social media, we collect specific information. This data collection occurs regardless of whether you have a Respire AI account, and your interactions through these channels should not be considered private. By accepting these terms, you acknowledge that engaging in any of the actions listed below constitutes a violation of this agreement:  Distribute, lease, lend, sublicense, sell, or transfer rights to the application or its associated content in any form. Alter, decompile, or disassemble the application in any manner. Change, copy, adapt, or translate the application without obtaining our prior written consent. Allow the application's use in a way that contravenes the stipulations of this agreement. Interfere with or circumvent any feature within the application designed to safeguard intellectual property rights. Bypass or undermine any controls set up to restrict access to content that is safeguarded by copyright laws. Collect data in a manner that facilitates its utilization by a rival product or service. Engaging in any of these prohibited activities will result in the immediate revocation of your license to utilize the application.
